Condominium ownership in brief

Condominium ownership (in French: propriété par étages, PPE) is governed by Articles 712a et seq. of the Swiss Civil Code (CC). Under Art. 712a CC, each co-owner has the exclusive right to use and to finish the interior of certain parts of a building. The common parts, on the other hand, are subject to joint administration. This is why the community needs an administrator.

The role of the PPE administrator

First, the assembly of co-owners appoints the administrator and supervises its activities (Art. 712m CC). The administrator then carries out the acts of joint administration in accordance with the law, the regulations and the decisions of the assembly. It also takes, on its own initiative, the urgent measures needed to prevent or remedy damage (Art. 712s CC). In addition, it allocates the common charges and costs among the co-owners and collects their contributions. Finally, it represents the community towards third parties in matters within its statutory powers (Art. 712t CC).
