The brokerage contract under Swiss law

Brokerage is governed by Articles 412 et seq. of the Swiss Code of Obligations (CO). Under Art. 412 CO, the broker is engaged, in return for a fee, either to point out opportunities to conclude a contract or to act as an intermediary in its negotiation. The rules on agency contracts generally apply to brokerage. Finally, Art. 413 CO provides that the broker is entitled to the fee as soon as the information provided or the negotiation leads to the conclusion of the contract.
