Condominium ownership in brief
Condominium ownership (PPE) is governed by Articles 712a et seq. of the Swiss Civil Code (CC). Under Art. 712a CC, each co-owner has the exclusive right to use and fit out certain parts of a building. Common parts, however, are jointly administered, which is why the community needs an administrator.
The administrator’s role
The co-owners’ meeting appoints the administrator and oversees their work (Art. 712m CC). The administrator carries out joint administration in accordance with the law, the regulations and the meeting’s decisions, and takes urgent measures on their own initiative to prevent or repair damage (Art. 712s CC).
They allocate common charges and costs among the co-owners, collect their contributions and represent the community towards third parties in matters within their legal remit (Art. 712t CC).
Frequently asked questions
Who appoints the condominium administrator?
The co-owners’ meeting, which also oversees their work (Art. 712m CC).
Who owns the renovation fund?
The community of co-owners. When you sell your unit you get no share of it back: it stays with the building.
Can you take over a condominium mid-year?
Yes. We take over the accounts, contracts and technical history from the previous administrator, then present a first budget to the meeting.
