Construction defects: the deadlines to know

For immovable works, the client has 60 days to notify the contractor of a defect. Any agreement imposing a shorter period is void (Art. 367 para. 1bis CO). Claims in respect of defects become time-barred five years after acceptance of the work (Art. 371 para. 2 CO). Where the contract incorporates SIA standard 118, defects may also be notified at any time during a two-year guarantee period from acceptance. This is why a rigorous acceptance of the work and follow-up after the works are essential.
